Terms of Service

1. Who we are

elch ("the Service") is operated by Elch Information Technology FZ-LLC ("we", "us"), a free zone company registered in Dubai, United Arab Emirates. You can reach us at support@elch.live.

Payments are processed by Paddle.com Market Ltd, which acts as the merchant of record for all purchases. Paddle's own terms apply to the payment transaction.

2. Agreement

By using the Service you agree to these terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation.

3. What the Service does

elch evaluates eDiscovery production packages against a documented set of structural rules, reports what it finds, and can apply a narrow set of provable repairs to load files. It also converts between supported load-file formats and rebuilds TIFF images as PDF documents.

Production files you select are processed inside your browser. They are not uploaded to us and we never receive, store, or have access to them.

4. What the Service does not do

These limits are fundamental, not temporary:

elch does not provide legal advice and is not a substitute for professional judgement.
"Verified" means the output has no blocking findings under elch's supported rules. It is not a legal conclusion, not a guarantee of admissibility, and not a promise that any destination platform will accept the package.
elch does not renumber Bates identifiers, invent document boundaries, reconstruct families, choose between ambiguous filename matches, or alter the contents of evidence files.
Image checks read file structure. They do not decompress every page and cannot confirm that an image is visually legible or complete.
A destination-platform precheck and human quality control remain your responsibility.

5. Accounts

Scanning does not require an account. Repair, export, and conversion require a subscription and an account. You are responsible for keeping your credentials secure and for all activity under your account. Provide accurate information and keep it current.

6. Subscription, trial, and billing

The Professional plan costs $10 USD per month.
Eligible new accounts receive a 30-day free trial. A valid payment method is required to begin the trial.
Unless you cancel before the trial ends, the subscription begins automatically and the first charge is taken.
The subscription renews monthly until cancelled. There is no minimum term.
One trial per account. We may decline a trial where billing records show one has already been used.
Prices may change. We will give at least 30 days' notice before a change affects your renewals.
Taxes are handled by Paddle as merchant of record and may be added at checkout.

7. Cancellation

You may cancel at any time from the billing portal. Cancellation stops future renewals. Access continues until the end of the period you have already paid for. See our refund and cancellation policy.

8. Acceptable use

You agree not to:

use the Service unlawfully, or to process material you have no right to process;
attempt to circumvent access controls, licensing, or usage limits;
interfere with, overload, or probe the Service or its infrastructure;
resell or redistribute the Service without our written permission;
misrepresent elch output as certification, legal advice, or a guarantee.

9. Your content

You keep all rights in the files you process. Because processing happens in your browser, we acquire no licence to them and no ability to access them. You are solely responsible for having the rights and authority to process the material you select.

10. Intellectual property

The Service, its software, and its documentation remain our property. Your subscription grants a limited, non-exclusive, non-transferable right to use the Service while it is active. Output you produce from your own files is yours.

11. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features. Where a change materially reduces what you have paid for, we will give reasonable notice.

12. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will detect every defect in a production, that its output will be accepted by any recipient, or that it will meet any specific delivery specification.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost data, sanctions, adverse rulings, rejected productions, or missed deadlines.

Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

14. Indemnity

You agree to indemnify us against claims arising from your use of the Service, your breach of these terms, or your violation of any law or third-party right.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms, unlawful use, or non-payment. On termination, your right to use the Service ends immediately.

16. Changes to these terms

We may update these terms. Material changes will be notified through the Service or by email before they take effect. Continued use after that constitutes acceptance.

17. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of the Emirate of Dubai have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
